IAMA Club Rules/Terms and Conditions
Inception Academy of Martial Arts (IAMA) Halswell and any future franchises are included in all references to “Inception Academy of Martial Arts (IAMA)” and “IAMA” throughout this form.
GENERAL CLUB RULES
- All Inception Academy of Martial Arts (IAMA) members and those using the club on a trial basis are expected to abide by the club's and membership's rules. Failure to do so may result in instant forfeiture of their membership.
- Any member or user of the facilities provided who conducts themselves improperly or knowingly violates any club rules may be refused access and have their membership terminated (refer to terms and conditions). IAMA reserves the right to change club rules at any time without notice.
- Respectable order, correct apparel, and consideration of the rights of others must always be practised while in or around the premise of the Inception Academy of Martial Arts (IAMA). Correct apparel is a shirt, top or singlet worn with pants or shorts, or the appropriate uniform/apparel for your chosen system.
- Inception Academy of Martial Arts (IAMA) will not be responsible for any loss or damage to the property of members, those trialling the facility or any person in or around the facility.
- Any reports relating to the conduct of others, care of the facility or staff should be reported directly to the Inception Academy of Martial Arts (IAMA) office or management.
- All Inception Academy of Martial Arts (IAMA) members must have a current and valid membership when using the facility.
- All members and those trialling the facility may be asked to pay reparations if they are responsible for loss or damage to equipment or property of both the facility and others. No property of Inception Academy of Martial Arts (IAMA) is permitted to leave the facility without the express permission of the business owners.
- Inception Academy of Martial Arts (IAMA) members should be aware of their own fitness limits and exercise to avoid exceeding them.
- Food is not permitted on the training floors at any time. Beverages consumed during workouts must be in a container with a lid and kept off the training floor. Members and users are also responsible for any mess and must clean up after themselves. No alcohol or smoking of any kind is permitted in or around the Inception Academy of Martial Arts (IAMA) premises.
- Members and users may not display actions that the Inception Academy of Martial Arts (IAMA) team of instructors and staff deems unsportsmanlike or rude. They also may not misuse, move or alter the club environment or property. Equipment must be handled with care; any intentional abuse will result in loss of membership. Equipment should be returned to its proper place after use.
- No abusive or provocative language. Respect other members
- Inception Academy of Martial Arts (IAMA) does not take responsibility for members or users of the facility and their general well-being when using any of the equipment, amenities, and facilities, with or without providing instructions on how to use any of these.
- Finally, train safely, respect others and have fun doing so.
TERMS AND CONDITIONS OF MEMBERSHIP AT INCEPTION ACADEMY OF MARTIAL ARTS (IAMA)
- Definitions
- “Agreement” means these Terms and Conditions of Membership, the Membership Registration Form, and the Club Rules.
- “Business Hours” means the hours in which the office and club is open and operational. The Business Hours are as per our current timetable but are subject without notice to change at our discretion.
- “Club Rules” means the rules pertaining to the use of the premises and facilities that are included in this contract - this includes any later changes to those rules.
- “Annual Membership Fee” means $50.00.
- “Minimum Term” means the minimum period in which a membership cannot be cancelled/terminated.
- “Member” means the person named on the membership registration form and any reference in the Agreement to “you” or “your” is a reference to the Member.
- “Training Fee” means the fee stated on the current Training Fees Price list/Timetable.
- “Premises” means that part of the building that is occupied by Inception Academy of Martial Arts (IAMA) head office or any other Inception Academy of Martial Arts (IAMA) owned or operated facility.
- “Term” Means the period of time specified on the membership application form which commences on the date of the agreement.
- “Us” means Inception Academy of Martial Arts (IAMA) and “We” and “Our” have similar meanings.
- The Agreement
- This is a legal document, and it is important that you understand the terms and conditions of your membership before you sign anything. If you have any questions, please do not hesitate to ask.
- The Agreement between you and Inception Academy of Martial Arts (IAMA) is made up of all of the legal documents in the Agreement.
- The Agreement replaces all prior agreements that exist between you and Us.
- Duration and Commencement
- The Term shall commence on the date of the Agreement.
- Members must be 16 years or older; however, if you are younger than 16, you may become an IAMA member, provided a parent or guardian signs the Agreement. Junior Karate members must have a parent or guardian remain on site for the class duration.
- Our Obligations
- We agree to take all reasonable actions to provide you with the services contracted in the Agreement. However, you acknowledge that our ability to provide those services may be affected by circumstances beyond our control, which, without limiting the scope, may include the closure of parts of the Premises in an emergency or to carry out refurbishments or repairs.
- Training & Membership Fees
- You agree to pay the Training Fee either upfront in advance of training or on a per-month basis, payable into Inception Academy of Martial Arts (IAMA) bank account no 03-0823-0043191-000 by the first day of each month for that month’s fees.
- Should you default on a payment due, you will have fourteen (14) days from the date the payment is due, to remedy such default. If the default is not remedied within fourteen (14) days, your membership may be terminated, and the debt passed to a collection agency. You will be liable to pay all outstanding fees, including the Dishonour Fee, as if you had continued as a member for the entire nominated Term.
- Annual Membership Fees are payable on joining and are recurring fees, so they are due again each year on the anniversary of when you originally joined the system that the annual membership fee is relevant to.
- Termination of Agreement
- Without prejudice to any other rights or remedies which the parties may have, we may terminate this Agreement immediately on giving written notice to you if:
- You fail to pay any amount due under the Agreement on the due date for payment, and such sum remains in default as set out in clause 5C; or
- You breach any term or requirement of the Agreement, the Club Rules, or you carry out any offensive, threatening, inappropriate, dangerous or illegal activity or behaviour on or in the vicinity of the Premises.
- On the termination of this Agreement for any other reason, you shall immediately pay Us all outstanding Membership Fees and return any of Our property which is in your possession for any reason.
- Privacy
- By completing this Agreement and the Membership Application Form, you are providing personal information about yourself to Us. You agree that We may use that information to manage your membership, update and maintain our records, provide you with information about events/specials, and recover outstanding debts, which may include giving your personal information to a debt collection agency.
- You may request access to your personal information at any stage and request changes.
- Rules of Membership
- The Club Rules govern your use of the facilities at the Premises. To become a member, you agree to comply with the Club Rules, binding rules that apply to all members, guests, and visitors. We reserve the right to update the Club Rules as and when we consider necessary.
- You understand that you are not permitted to teach or instruct any form of Inception Academy of Martial Arts (IAMA) curriculum or syllabus without the written consent of the club head, Dr. Matt Walley.
- Use of the Club
- You agree to use the club and its facilities at your own risk.
- You confirm that you are fit and healthy to the best of your knowledge and have not been advised by a medical practitioner or any other health professional that exercise is dangerous to your health.
- We are not responsible for any injury caused, whether during exercise or not, while using our facilities or being present on the Premises.
- General
- We reserve the right to change this Agreement or the Club Rules. Any such changes will be notified to you at least twenty (20) days before such change becomes effective through notices placed either in and on the Premises or in writing to your last known email or postal address as noted on your Membership Application Form. You agree to be bound by any such changes.
- The rights given to you under this Agreement are personal and cannot be assigned or transferred to any other person.
- The laws of New Zealand govern this Agreement. The parties agree to submit to the non-exclusive jurisdiction of the Court of New Zealand.
- All items listed in the terms and conditions and club rules apply to any operationally participating Inception Academy of Martial Arts (IAMA) facility.
- Inception Academy of Martial Arts (IAMA) is not obligated to offer a refund on any membership, personal training, or products sold. There are no exchanges. Missed lessons cannot be credited or refunded. Still, they can be made up in the same paid calendar month by attending additional classes at any Inception Academy of Martial Arts (IAMA) location.
- Inception Academy of Martial Arts (IAMA) is open for timetabled classes all year round except for Public Holidays and a short period over Christmas / New Year. Training fees are averaged out throughout the year to allow for these closures. You are welcome to attend make-up lessons as per above.
- Notices
- Our address for service is c/o Inception Gym, 65 Blenheim Road, Addington, Christchurch 8014.
- Your address for service is either your email address set out in the Membership Registration Form.
- Costs
- All costs, claims, damages, losses, and liabilities incurred by enforcing the Agreement, including Our solicitor costs and any other agency We are required to employ, will be payable by you.
